A copy of the Earl of Kent’s deeds and the Lady Elizabeth his wife, to William Allestry and John Buxton Ref: Derbyshire Record Office D76 ME10

Sir Gilbert Talbot the 7th Earl of Shrewsbury held extensive lands in Derbyshire.  On his death in 1616 his lands were divided between his three daughters; Alethea who became Countess of Arundel by her marriage to Thomas Howard, Elizabeth who married Henry Grey, 8th Earl of Kent in 1601 and Mary who married William Herbert, 3rd Earl of Pembroke.
In May 1633 William Allesty of Grays Inn and John Buxton of Brassington commenced an extensive programme of property acquisition.  They purchased property in Pleistow, Wheatcroft, Tansley, Lea, Over Holloway and Nether Holloway from the Earl and Countess of Kent for the sum of £1100. A transcription of this document from the Derbyshire Record Office, Ref: D76 ME10 is reproduced below. In June 1633 they purchase further properties in the same locations from Thomas Babbington of Leicester for the sum of £310 (Ref: D76 ME11) and in 1634 sold certain of the Lea properties to Thomas Blackwall of Mansfield Woodhouse (Ref: D76 ME12, D1088 T13 and D1088 T14) and one of the Over Holloway properties to Robert Wilcockson (Ref: Derbyshire Local Studies Library Deed 4609).


This Indenture made the fifteenth day of May in the ninth year of the reign
Of our Sovereign Lord Charles by the grace of God of England Scotland ffrance and

Earl of Kent and the Lady Elizabeth his wife Countess of Kent of the one part, and William
Allestry of Grays Inn in the County of Middlesex Gent and John Buxton of Brassington in
The County of Derby Gent of the other part Witnesseth that they the said Henry Earl
Of Kent and the Lady Elizabeth his wife for and in consideration of the sum Eleven Hundred
Pounds of lawful money of England to them in hand paid by them the said William Allestry and
John Buxton, the receipt whereof the said Earl doth hereby acknowledge and thereof and every
Part thereof acquit exonerate and discharge them the said William Allestry and John Buxton
Their heirs executors and administrators and every of them for ever by these presents and for other
Considerations them thereunto moueing have granted bargained sold and confirmed and do
By these presents for them and their heirs absolutely grant bargain sell and confirm unto them

Hereditaments of the said Henry Earl of Kent and Lady Elizabeth his wife or either of
Them situate lying and being within the towns fields precincts or territories of Lea
Als Lee Tansley Over Holloway Nether Holloway Wheatcroft and Pleistow aforesaid or any of them, and
All ways waters watercourses watering places commons Common of Turbury and of pasture liberties
Easements privileges franchises and appurtenances whatsoever to the said messuages cottages lands
And promises or any of them belonging or in any wise appertaining, or to or with the same
Or any of them usually demised occupied or enjoyed or reputed taken or known as part parcel or
Member of any of them, and heretofore hold and enjoy under any yearly rent usually
Paid to the said Earl and Countess or either of them, as all and every the lands tenements and
Hereditaments by these presents intending to be bargained and sold have been formerly hold and enjoyed
And the reversion and reversions, remainder and reminders rents and services of all and singular the
Aforesaid premises and every part thereof, And all the estate right title interest claim and demand
Of them the said Earl and Countess or either of them of in or to the same or any part thereof, And they
The said Earl and Countess do hereby for the consideration aforesaid grant bargain and sell unto the
Said William Allestry and John Buxton their heirs and assignees, All deeds evidences and writings
Solely concerning the premises or any part thereof and true copies of all other deeds writings
And evidences touching or concerning the said messuages lands and premises or any part of
Them jointly with any other lands tenements or hereditaments, the same copies to be written out
At the costs and charges of the said William Allestry and John Buxton their heirs or assignees
To have and to hold the said Manor and all the aforesaid messuages cottages lands
Tenements and hereditaments, and all and singular other the premises with every of their appurtenances
Unto them the said William Allestry and John Buxton their heirs and assignees forever, to the only
Proper use and behoofe of them the said William Allestry and John Buxton their heirs and assignees
For ever, to hold of the chief Lord or Lord of the Fee or Fees by the rents and services therefore due and
Of right accustomed And the said Earl and Countess of them and their heirs the said Manor
Messuages cottages lands and all other the promises above mentioned and intended to be bargained
And sold with their and every of their appurtenances to them the sais William Allestry and John
Buxton their heirs and assignees, against them the said Earl and Countess their heirs and assignees
And against the heirs and assignees of Gilbert the late Earl of Shrewsbury and the Lady Mary his
Wife deceased shall and will warrant and for ever defend by the pntes And the said Earl and
Countess do by these presents for them and their heirs executors and administrators and every of
Them covenant promise and grant, to and with them the said William Allestry and John Buxton
Their heirs and assignees and every of them, that it shall and may be lawful to and for the said
William Allestry and John Buxton their heirs and assignees from time to time and at all times
Hereafter for every lawfully peaceably and quietly to have hold use occupy possess and enjoy


The aforesaid Manor Messuages Cottages Closes Lands tenements and hereditaments and all
And singular other the premises with their and every of their appurtenances and every part and
Parcel thereof without any lawful let suit trouble eviction molestation or disturbance of them
The said Earl and Countess or either of them their heirs or assignees or of any other person or persons
Whatsoever lawfully claiming or hereafter to lawfully claim, by from or under them or either
Of them, or by from or under the afore named Gilbert late Earl of Shrewsbury and the Lady Mary
His wife or either of them or by from or under them or any of their estates rights or titles And the
Said Earl and Countess his wife do hereby further for themselves their heirs executors and administrators
And every of them covenant promise grant and agree, to and with them the said William Allestry and
John Buxton their heirs and assignees, that all and singular the aforesaid promises with every of their
Appurtenances, and every part thereof now are and be and so from time to time and at all times
For ever here after shall continue and be unto them the said William Allestry and John Buxton
Their heirs and assignees free and clear and clearly acquitted and discharges or otherwise upon reasonable
Request to be made well and sufficiently saved and kept harmless of and from all manner of former
And other bargains sales gifts grants jointures dowers leases statutes merchant and of the staple
Rent charges, rent seckes arrearages of rent services fines peasures forfeitures, issues amercements
Debts and duties to the King recognisances indgments executions, And of and from all other titles
Troubles charges and encumbrances whatsoever had made committed done suffered or consented
Unto by them the said Earl and Countess or by the said Gilbert Earl of Shrewsbury and
Lady Mary his wife or any of them or any other person or persons lawfully claiming by from
Or under him her or them or by their or any of their assent means or procurements
And the said Henry Earl of Kent and the said Countess of Kent, do by these presents further
For themselves their heirs executors administrators and every of them covenant promise and
Grant to and with them the said William Allestry and John Buxton their heirs and assignees, that
That they the Earl and Countess and their heirs shall and will from time to time and at all
Times hereafter during the space of seven years now next ensuing the date hereof at the
Reasonable request and at the proper costs and charges in the law of them the said William Allestry
And John Buxton their heirs and assignees make do and acknowledge suffer and execute, or cause and
Procure to be had made done acknowledged suffered and executed, All and every such further and other
Reasonable and lawful act or acts thing or things device or devices in the law whatsoever for the
More fuller plain better and perfecter assurance suertie suer making and conveying of all

Allestry and John Buxton their heirs and assignees or their counsel learned in the law shall be reasonably

Deed or deeds enrolled or not enrolled enrolment of the presents recoverie or recoveries, with single or
Double voucher or vouchers over release or confirmation, or by all or any of the ways or means aforesaid or
Otherwise howsoever so as the same conveyances or assurances contain no farther or other warranty
Then as aforesaid, And so as the said Earl and Countess nor the p(ar)ty or p(ar)ties that so shall levy
Acknowledge suffer or execute the same, be not enforced to labour or travel, for the executing or p(er)fecting
Of any such assurances, from his her or their dwelling place or abode at the time of such request to be
Made, And finally it is covenanted granted concluded and fully agreed upon, by and between all
The p(ar)ties to these presents , And the said Earl and the said Countess or any other person whatsoever , unto
To the said William Allestry and John Buxton their heirs or assignees or to any other by the denomination
And appointment shall be and shall be construed deemed and taken to be and hereby declared
To be to the sole proper use and behoofe of them the said William Allestry and John Buxton their heirs
And assignees for ever, According to the true intent of these presents, And to no other use intent or
