(Anthony Babington was an English nobleman from Dethick, Derbyshire. At the age of 24yrs he was convicted with others of plotting the assassination of Elizabeth I of England and conspiring with the imprisoned Mary, Queen of Scots. The "Babington Plot" and Mary's involvement in it were the basis of the treason charges against her which led to her execution. Babington along with six others were hanged, drawn and quartered on the 20th September 1585 and his lands seized by the Queen.)

THIS INDENTURE made the first day of August in the nine and twentieth year of the reign of our Sovereign Lady Elizabeth by the grace of God of England France and Ireland Queen Defender of the faith BETWEEN Sir Walter Raleigh of Solaton Raleigh in the county of Devon, Knight, of the one part AND Richard Wharton of Kingston in the County of Nottingham, Yeoman and John Hopkinson of Ashover in the County of Derby, Yeoman, of the other part WITNESSETH that the Queen’s Most Excellent Majesty by her most gracious Letters Patent bearing date the seventeenth day of March in the nine and twentieth year of Her Majesty’s reign of her certain knowledge and mere motion amongst other things did give and grant unto the said Sir Walter Raleigh Knight ALL THAT her Mannor of Leigh with all and singular the rights members and appurtenances in the said County of Derby which were lately parcel of the possessions of Anthony Babington and which to Her Majesty were forfeited by the attainder1 of the said Anthony Babington And also where the said Queen’s Majesty did by her said Letters Patent grant unto the said Sir Walter Raleigh Knight the messuage or tenement in Over Holloway with all lands thereto belonging in the occupation of One Richard Wilkinson als Wilcockson by the name of All that messuage or tenement with the lands thereto belonging in Crich now or some time in the tenure of Richard Wilkinson or of his assigns which were lately parcel of the possessions of the aid Anthony Babington and which to Her Majesty were forfeited by the attainder 1 of the said Anthony Babington And all that the parcel of land called Dethick Haye, containing by estimation sixteen acres of land situate and being in the said County of Derby which were until lately parcel of the possessions of the aforesaid Anthony Babington and which to Her Majesty were forfeited by the aforesaid attainder of the said Anthony Babington And also all that the messuage with their appurtenances and divers lands and tenements situate lying and being in Tansley in the said County of Derby which were lately purchased of one William Johnson or some time in the tenure or occupation of James Pidcock or his assigns and which were lately parcel of the possessions of the aforesaid Anthony Babington and which to Her Majesty were forfeited by the aforesaid attainder of the said Anthony Babington TO HAVE AND TO HOULD amongst other things all the said premises with all and singular their appurtenances to the said Sir Walter Raleigh Knight his heirs and assigns for ever To the proper use and behoofe of the said Sir Walter Raleigh his heirs and assigns for ever without any account rendering or maling to Her Majesty her heirs and successors for the said premises And to hould all the said premises which were before houlden of Her Majesty by the said Anthony Babington of Her Majesty her heirs and successors by such rent and services as the said Anthony Babington before held the same and not otherwise and if any of the said premises now houlden by the said Anthony Babington of any other person or persons and not of Her Majesty her heirs and successors they shall be houlden of her, her heirs and successors as of her Mannor of East Freensmich(??) within the County of Hants(Kent ?) by fealties onely in free & common soccage2 & not in capite nor by Knight’s service .

NOW THE SAID Sir Walter Raleigh Knight for and in consideration of the whole and entire sum of five hundred pounds of good and lawful money of England by the said Sir Walter Raleigh Knight received of the said Richard Wharton and John Hopkinson before the delivery of these presents whereof he doth acknowledge himself well and truly satisfied and thereof and of every part and parcel thereof doth acquit and discharge the said Richard Wharton and John Hopkinson and their executors for ever. HATH GRAUNTED bargained and sould and by these present indentures doth surely and absolutely grant bargain and sell unto the said Richard Wharton and John Hopkinson ALL the said Mannor of Leigh with all and singular his rights members and appurtenances and also all lands, tenements and hereditaments in Over Holloway and Crich aforesaid in the occupation of the said Richard Wilkinson als Wilcockson or his assigns And also all the said parcel of land called Dethick Haye with their appurtenances hereto belonging and the aforesaid messuages with their appurtenances and divers lands and tenements in Tansley aforesaid which were lately purchased of the aforesaid William Johnson or sometime in the tenure or occupation of James Pidcock or his assigns and all and every the reversion remainder and interest in the said premises and every part thereof with their appurtenances in as ample mannor and form as if they were given and granted by the said Letters Patent to the said Sir Walter Raleigh and his heirs TO HAVE AND TO HOULD all the said mannor of Leigh with all and singular his rights members and appurtenances and also all lands tenements and hereditaments in Over Holloway and Crich aforesaid and all that said parcel of land called Dethick Haye with the appurtenances thereto belonging and all the aforesaid messuages with their appurtenances and divers lands and tenements in Tansley aforesaid and all the reversion remainder and interest in the said premises and every part thereof with their appurtenances unto the said Richard Wharton and John Hopkinson their heirs and assigns to their own proper use & behoofe for ever. AND THE SAID Sir Walter Raleigh Knight for himself his heirs executors and administrators doth covenant and grant to and with the said Richard Wharton and John Hopkinson their executors and administrators by these presents that the said Sir Walter Raleigh is and at the time of these sealing(the selling ?) and delivery of these presents shall be forfeit(seized ?) of all the said premises of such an estate by power(force ?) of the said Letters Patent as same(came ?) to the Queen’s Majesty by the attainder of the said Anthony Babington and that the said Sir Walter Raleigh hath full power and authority to grant bargain and sell the premises and every part and parcel thereof before bargained and sold or by these presents intended to be bargained and sold and that all and every the said premises and every part and parcel thereof now is and at all times hereafter shall continue and be clear and thereby(clearly) discharged of and from all manner of charge statutes merchant statutes staples recognizances judgements executions and all other incumbrances whatsoever made suffered or done by the said Sir Walter Raleigh or by his assent or pronouncement AND ALSO the said Sir Walter Raleigh doth further for himself his heirs executors administrators and assigns covenant and grant to and with the said Richard Wharton and John Hopkinson their executors and administrators by these presents that the said Sir Walter Raleigh and his heirs shall at all times and from time to time after the sealing and delivery of these presents during the space of three years then next ensuing upon reasonable request to be made of the said Sir Walter or his heirs at the proper costs and charges in the name of the said Richard Wharton and John Hopkinson and their heirs make all such allowance and assurances act and acts for the sure maling and conveying of the premises and every part and parcel thereof by sign ******* or ********* or recoveries with (followed by six unreadable words in pencil) or warranties or otherwise against the said Sir Walter Raleigh and his heirs and against Thomas Kinnersley of Rockesley (?) in the County of Stafford Gent. his heirs and assigns as shall be devised or advised by the said Richard Wharton and John Hopkinson and their heirs and by their Counsel learned in the land AND THE SAID Sir Walter Raleigh doth(?) covenant and grant for himself his heirs executors and administrators to and with the said Richard Wharton and John Hopkinson their heirs and assigns by these presents to warrant and defend all and every the said premises before in these presents mentioned to be bargained and sold and every part and parcel thereof with their appurtenances against the said Thomas Kinnersley of Rockesley (?) in the county of Stafford Gent. and his heirs and also of and from one annuity or yearly rent of one hundred marbles3 by the year granted to one Henry Foljambe4 of Kingston Esquire by the said Anthony Babington and of and from all and every other lawful tithe(title ?) claim or interest remaining in Her Majesty her heirs and successors or any of Her Majesty’s servants or tenants.

3 The statement of “100 Marbles” may be a mis-transcription from the original document as in the Wolley Manuscripts ADD MS 6702, p21 now at the British Library it states Anthony Babington of Dethick and Kingston Esq. of age 24 October 24 Eliz 1582 , grants to his loving father-in-law Henry Foljambe of Kingston in acknowledgement of trouble and expenses incurred during his minority, 100 marcs per annum, charged upon Dethick, Lea , Ashover, Wirksworth , Chriche &c.

4 Henry Foljambe was the step father of Anthony Babington. He lived at Dethick during the minority of Anthony and was one of his three guardians. The other were Anthony’s mother and Phillip Draycot of Paynsley, Staffordshire.
